The length of stay is not relevant to the complaints indicated above. If you screen your vacationers and have clear house rules posted, everyone can enjoy a safe stay!
Short term Vacation Rentals and Private Property Owners rights are at risk!!
Vacation Rental Home Owners and Investors:
Did you know Volusia County has started a campaign to stop vacation rentals in both condominiums and single family homes unless you rent a minimum of 1 month (30 days)? Hundreds of Vacation Rental Owners have received violations from the County. Most of the violations are not generated by neighbor complaints.
The County uses vacation rental platforms like VRBO and AIRBNB to locate us. They are so savvy on these platforms that they view our calendars to see if we show rentals less than a 30 day + duration.
Some local area residents also use the vacation rental platforms because they do not want vacation rental homes on their street. The use the vacation rental platforms to send you inquiries, and if you answer that you will rent to them less than 30 days, they will turn you into the County.
Did you also know you can be fined $1,000 a day for non-compliance, or $5,000 a day for repeat violations or a one-time fine not to exceed $15,000 may be imposed?
Condo owners that have an HOA that states they can rent less than 30 days duration have also received notice of violations from the County. Just because your HOA states you can rent less than 30 days, Volusia County has an old land use ordinance that states you cannot.
The description of the municipal code is stated as follows: Hotel/Motel where not permitted and use of premises where not permitted under the R-4 (R-3, R-5, R-6, R-7, R-8) zoning classifications. Look up on Code of Ordinances County of Volusia, Chapter 72 Article II Divisions 7, Section 72-241.
You may not have had an issue yet, but this can change at any time. We are a group that has come together to make a change in the current land use ordinance stated above. We cannot do this alone, we need every person that has a home that they rent less than 30 days to join us. There is strength in numbers!!
Realtors and Brokers:
Volusia County is impacting your bottom line! A land use ordinance created in 1984 is now being enforced. Most residents and businesses were not even aware such an ordinance existed. Volusia County seems to be siding with the Hotel/Motel industry and sending short term vacation rental home and condos violations stating we are operating as a hotel/motel. Our Vacation Rental license from the State of Florida does not classify our homes as a hotel/motel, we are classified as a Vacation Rental Home.
If investors find out that Volusia County is no longer short term Vacation Rental Home friendly, they will no longer buy condominiums and single family homes from you. Homes will sit on the market longer, and property values will decline. Please help our group by joining our fight for property rights. It is time Volusia County steps up to the plate and create an ordinance that everyone can live with. We need your support!
Did you know Volusia County is impacting your tourism dollars our vacationers are spending in your place of business? You may not have seen the full effect yet, but you will in the near future if we do not take action now!
The County is trying to stop all Short Term Rentals. All of Florida, including Volusia County thrive on tourism dollars, it is a multi-billion dollar industry. It creates new jobs which helps the overall economy. Our homes are typically a less expensive option that allows vacationers to stay longer than they can afford at a hotel, this means they spend more money in your establishments.
Please help our group by funding our fight for property rights. It is time Volusia County steps up to the plate and creates an ordinance that makes sense! We are all supporting Fair Regulation that addresses what 99% of all complaints are about: Trash, Noise, and Garbage.
Many local residents view short term vacation rentals as a nuisance to the community. Did you know that short term vacation rentals actually drive up property values? People purchase these homes as a second home or a future retirement home. They share their home with others to help with expenses. Short term rentals generate revenue for the County and the State by collecting sales tax of 12.5%.
These vacationers spend millions of dollars in Volusia County each year creating jobs and increasing local businesses revenue. Dilapidated homes are purchased and turned into beautiful homes with a positive impact on property values. The vacationers that come to visit are good people looking for a family vacation. Vacation Rental ordinances that are fair to all include rules around trash, parking and noise. Please help keep your neighborhood beautiful and support our cause!
